1. Introduction
Thanks for using TrafficEye.ai ("Service"). The Service is provided by Eyedea Recognition s.r.o., located at Pod Hybšmankou 7, 150 00 Prague 5, Czech Republic.
These Terms of Service ("Agreement") explain the terms by which you may use the Service. Our Privacy Policy explains how we collect and use your information.
Your use of the Service requires that you agree this Agreement. Please read them carefully. If you do not understand the Terms, or do not accept any part of them, then you should not use the Service.
2. Age Requirements
By accessing the Service, You confirm that You are at least 13 years old and meet the minimum age of digital consent in Your country. If You are old enough to access the Service in Your country, but not old enough to have authority to consent to our terms, Your parent or guardian must agree to our terms on Your behalf.
Please ask Your parent or guardian to read these terms with You. If You are a parent or legal guardian, and You allow Your teenager to use the Service, then these terms also apply to You and You are responsible for Your teenager’s activity on the Service.
3. Your Information
By using the Service, You agree that Eyedea Recognition s.r.o. can use Your information in accordance with our Privacy Policy.
4. Content on the Service
You are responsible for your use of the Service and for any Content you provide, including compliance with applicable laws, rules, and regulations. Any use or reliance on any Content or obtained by you through the Service is at your own risk.
When providing Content, you affirm, represent, and warrant that: (a) the Content does not violate any laws or regulations, (b) you own the Content or have the necessary rights and permissions to use the Content, and (c) the Content does not infringe upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.
In the case of uploading images from traffic cameras, you are responsible for ensuring that these images comply with all local and national laws and regulations. You must have the necessary permissions to use these images. We are not responsible for any legal issues that arise from the use of these images.
5. User Registration
By registering for an account, you agree to provide accurate, current, and complete information about yourself as prompted by the Service's registration form and to maintain and promptly update the information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.
6. User Conduct
As a condition of use, you promise not to use the Service for any purpose that is prohibited by the Terms of Service. You are responsible for all of your activity in connection with the Service. Additionally, you shall abide by all applicable local, state, national, and international laws and regulations and, if you represent a business, any advertising, marketing, privacy, or other self-regulatory code(s) applicable to your industry.
7. Using the Service
Our Service evolve constantly. As such, the Service may change from time to time, at our discretion. We may stop (permanently or temporarily) providing the Service or any features within the Service to you or to users generally. We also retain the right to create limits on use and storage at our sole discretion at any time. We may also remove or refuse to distribute any Content on the Service, suspend or terminate users, and reclaim usernames without liability to you.
8. Unlawful Activities
If we are notified or become aware of any unlawful activities related to our Service, we will take appropriate action. This may include, but is not limited to, reporting the unlawful activities to the relevant authorities, removing your access to some or all of our Service, disabling your account, and/or cooperating with any investigations. We reserve the right to take these actions at any time, in our sole discretion, with or without notice, and without any liability to the user who is terminated or to the user whose access is blocked.
9. Compliance with Law Enforcement
We reserve the right to review your data and content to ensure compliance with this Agreement and the law. If required by law, regulation, legal process or governmental request, or where we have reason to believe that a user is in breach of these Terms of Service or is engaged in illegal activities, we may inspect your data and content, and take any actions we deem appropriate, including reporting to law enforcement authorities.
10. Termination
Eyedea Recognition s.r.o. may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your account, you may simply discontinue using the Service. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Warranty Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Eyedea Recognition s.r.o. its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
We reserve the right to modify these Terms at any time. If we do this, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. We will also notify you, either through the Service user interface, in an email notification or through other reasonable means.
By using our Service, you agree to these terms. If you do not agree to these terms, please do not use our Service.
